General Terms And Conditions

Stepcraft offers equipment, machine assembly kits, software, accessories, services and support services. The General Terms and Conditions (GTC) presented on this page define the business relationship between you (customer/buyer) and Stepcraft in effect at the time of the order. Other conditions are only valid if they have been accepted by us in writing.
Please read these terms carefully before you place an order at Stepcraft. By placing an order at Stepcraft you agree that your order will be subject to these conditions.
2. Contractual Agreements
STEPCRAFT concludes contracts with both customers who are legally capable natural persons over 18 years of age and legal persons.
Your order constitutes an offer to conclude a purchase contract. The contract is finalized when you receive a written confirmation of receipt of the order (order confirmation) from us.
In the online store, your order constitutes an offer to conclude a purchase contract with Stepcraft. When you place an order at Stepcraft, we will send you an e-mail confirming the receipt of your order and its details (order confirmation). This confirmation does not constitute acceptance of your offer, but is only intended to inform you that your order has been received. A contract is only concluded when we ship the product to you and confirm the shipment to you in a second e-mail (shipping confirmation). Additionally, a contract for safety-critical products is only concluded after you signed the proof of the safety instruction as well as the deed of release legally binding and returned it to us.

All prices are gross respective to the end user in the agreed currency, including VAT plus additional shipping fees. For registered retailers, prices are shown net plus additional shipping fees. We reserve the right to adjust prices if technical adjustments are made to the product at your request between the time of the offer and the time of contract fulfilment. Offers are not binding, especially in brochures that do not record any expiration dates.
4. Payment terms and retention of title
The invoice amount is payable using the payment methods listed in the online shop (payment in advance by bank transfer or PayPal). For registered retailers, the payment can be made by invoice. This must be agreed in writing in advance. All products remain the property of Stepcraft GmbH & Co. KG until payment has been completed in full.
Unless agreed otherwise, delivery shall be made to the address specified by the purchaser. There are the following exceptions: when paying with PayPal, shipments will only be made to the address that you have saved under PayPal "Transaction Details".
On the website you can find information about the availability of products that are sold by Stepcraft. We would like to draw your attention to the fact that all information concerning availability, shipment or delivery of a product are only estimated times and approximate values. They do not constitute binding deadlines nor guaranteed shipping or delivery dates. If Stepcraft notes while processing your order that your ordered products are not available, you will be notified separately by e-mail. The statutory rights of the buyer are not affected.
If you order products from Stepcraft for delivery outside of the EU, they may be subject to customs and taxes. Any additional charges for customs clearance must be borne by you.
6. Warranty, liability and defects
Despite extensive testing, it cannot be excluded that our products may occasionally present defects. Damage can also occur in transit, so please check the packaging when accepting a delivery.
In contractual agreements with non-merchants (end customers), we provide a defect-free warranty for two years after delivery. In contractual agreements with merchants (between companies), we provide a one-year defect-free warranty.
Customers must submit a written communication of any defects within ten days of receiving the purchase at their destination of choice. This applies to non-retail customers only for obvious defects. Any such complaints will only be taken into account if the goods are still in the same state they were in at delivery.
We will accept the return of merchandise that we acknowledge to be defective, and we will offer a non-defective replacement. Instead, we can offer compensation for the reduction in value of a defective product. If a repair or a replacement delivery fails, non-retail customers have the right to request a reduction of purchase price or the rescission of the purchase contract. Further claims of consequential damages on the part of the buyer are excluded unless they are based on a defect covered by the warranty. The buyer must allow reasonable time and opportunity for the supplier for the correction of faults. If he refuses, then the supplier is exempt from responsibility due to defects.
A return of defective goods is only to be performed with our consent and in the original packaging or equivalent packaging. Freight costs are to be covered by the buyer. A refund will only take place in case of a justified complaint. Our liability, regardless of the legal reason, is limited to malice and gross negligence.
Any technical advice given will be to the best of our knowledge. All specifications and information available concerning suitability and application of our products are non-binding and do not exempt the buyer from performing their own tests and trials. The buyer is himself responsible for compliance with all laws and regulations regarding the use of the goods. For suitability of the product for specific purposes, we are only liable if it is expressly guaranteed in writing.
The guarantee and liability assured by Stepcraft are limited to damages that demonstrably occurred as a result of defective material, faulty design or poor execution. Damage due to natural wear and tear, insufficient maintenance, failure to observe assembly instructions or operating instructions, excessive, unsuitable or incorrect usage, as well as other reasons that Stepcraft does not provide for are explicitly excluded.
In no case can the buyer claim compensation for damage not caused to the delivered goods themselves, like for example loss of production, loss of use, loss of orders, lost profit and other direct or indirect damage.
The above limitations of liability do not apply in the case of damage to life, body or health, for defects covered by a guarantee regarding the product's state, or defects concealed with malicious intent. Liability under product liability law remains unaffected.
Where the liability of Stepcraft is excluded or limited, the same is also true of the personal liability of employees, representatives and agents.
7. Manufacturer`s warranty
In addition to the implied warranty we provide manufacturer's warranty on our products. The precise modalities can be consulted in the warranty conditions.
8. Changes to the terms and conditions
We reserve the right to make changes to our website, rules and regulations, including these terms and conditions at any time. Your order is subject to all sales conditions, contractual conditions and general terms and conditions that are in effect at the time of order, unless changes to these conditions are required by regulations or legal reasons. If any provision in these terms and conditions is invalid, void or unenforceable for any reason, this provision will deemed severable and will not affect the validity and enforceability of the remaining provisions.
9. Applicable law and jurisdiction
German law applies, excluding the UN Sales Convention (CISG). The legal domicile for the supplier is the headquarters or branch office, and the legal domicile for the buyer is to be determined by the buyer.
